1 Compliance with these Terms and Conditions
(a) Please read these terms and conditions carefully. By using schots.com.au (Website) including any of the functions available on the Website, you agree to bound by, and comply with, these terms and conditions (Terms) and our Privacy Policy (which is available here).
(b) We reserve the right to amend these Terms from time to time at Our discretion ("Amendments"). Amendments will be effective immediately. Where practicable we will endeavour to notify you of the Amendments to the Terms. Your continued use of the Website following any such Amendment will represent an agreement by you to be bound by the Amendments to the Terms. We suggest you check the Terms regularly to ensure you are aware of the most up to date terms.
(c) This Website may contain links to other websites (Linked Sites), which are not operated by Website Owner. The Website Owner has no control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of the Linked Sites. Your use of the Linked Sites will be subject to the Terms of Use and service contained within each such Linked Sites, if any.
2 Our Contract
(a) These Terms are between Karmy Pty Ltd (ABN 73 753 247 573) and Schots Home Emporium (ABN 74 660 550 238) (referred to as We, Us or Our) and you (You or the Customer).
(b) These Terms govern your use of our Website. However, where applicable, clauses 3 to 12 inclusive and 20 of these Terms apply to all transactions made by you with Us including in store purchases.
(c) Our Website is a retail shopping (including e-commerce) Website where you can browse, select and order goods advertised from Us. Your access to and use of the Website, including your order of goods through this Website, is subject to these Terms and the Privacy Policy.
(d) Access to the Website is permitted on a temporary and limited basis for the purpose of browsing the Website and interacting with the Website Owner. We reserve the right to withdraw or amend the Website and any Good or Services listed on the Website without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or all of this Website.
(e) When You place an order via Our Website, you will receive an order confirmation email confirming receipt of your order (Confirmation Email). This Confirmation Email will only be an acknowledgment of your order and will not constitute acceptance of your order.
(f) A contract between Us will not be formed until We send You confirmation by email that the Goods which you ordered have been sent to you (Dispatch Email).
(g) Only those Goods listed in the Dispatch Email will be included in the contract formed between You and Us (Contract).
3 Credit Agreement
(a) A Credit Agreement means a credit agreement entered into between the Us and You for the supply or future supply of goods on credit.
(b) Where a Customer has a Credit Agreement, where provisions of the Credit Agreement are inconsistent with the provisions of these Terms, the provisions of the Credit Agreement must take precedence over the provisions of these Terms which must be read subject to the provisions of the Credit Agreement.
4 Pricing and availability
(a) Prices are as marked. For orders on our Website, the prices listed at the time you place your order are final.
(b) All prices quoted on this website are in Australian Dollars (AUD) only and any online purchases made through this website will be processed in AUD only.
(c) Due to different screen resolutions, colours depicted in marketing and sales materials may vary to that of the actual product.
(d) Delivery costs will be charged in addition to the purchase price and such additional charges are clearly displayed where applicable and included in the "Total Cost".
(e) All payments are processed through Stripe or CBA Powerboard, a secure payment gateway, only the last 4 digits of card numbers will be stored for transaction verification purposes by Us. All information passed between this site and the bank's secure payment gateway is done so via a secure connection with 128-bit encryption.
(f) We use reasonable commercial efforts to ensure that all details, descriptions and prices of the goods which appear on this Website (Goods) are accurate. However, listing errors may occur in relation to such details, descriptions, and prices (Error). If We discover an Error in relation to any Goods You have purchased, We will endeavour to correct the Error as soon as practicable.
You should contact the store on (03) 9482 6400 to check on availability of any product displayed on the Website, if you are unsure. In certain circumstances, We may need to reject your order. This may happen where the requested Product is not available or if there is an error in the price or the product description posted on the Website.
5 Payment
Once We receive your order, We carry out a standard authorisation check on the credit or debit card you provided to Us at time of checkout (Card) to ensure there are sufficient funds to fulfil the transaction. Your Card will be debited upon authorisation being received. The monies received upon the debiting of your Card must be treated as a deposit against the value of the Goods you wish to purchase. Once the Goods have been dispatched and a Contract exists after your Dispatch Email has been sent, the monies paid as a deposit must be used as consideration for the value of Goods you have purchased as listed in the Confirmation Email.
6 Delivery of Goods
6.1 Delivery
(a) All standard orders in Australia, are sent by Courier without insurance or tracking.
(b) While We do everything We can to ensure your order is delivered in a timely manner, We will not be liable for any loss or damage incurred by any person as a result of delay caused by Our carrier that We have no control over or by any event which is out of Our reasonable control or foresight including but not limited to any delay caused by an incorrect delivery address being provided to Us.
(c) Insurance is available at an extra cost on all delivery services. We will not cover any loss of Goods that are not insured.
(d) For non-delivery of Goods, please notify Us by email as soon as possible. Non-delivery of Goods must be reported to Us as soon as possible.
6.2 Click & Collect
(a) For some orders we offer a Click & Collect option from either our Clifton Hill or Geelong Warehouse.
(b) We will prepare each order for collection at Our premises by you or your agent or your courier as soon as possible after the placement and payment of the order has been made. As soon as the order is ready, you will be notified that the order is ready for collection (Collection Notice). You must collect your order within 7 days of receiving notification that the order is ready for collection.
(c) If your order is not collected within 7 days of receiving the Collection Notice, we reserve the right to charge You for the storage of uncollected goods at reasonable, commercial rates which have been notified to You at the time of ordering.
(d) If your order is not collected within 14 days of receiving the Collection Notice, we will notify You of Our intention to dispose of the goods and to recover our costs in doing so, which can occur at any time, at Our discretion, after a further 14 days.
(e) While We do everything, to ensure your order is ready in a timely manner, We will not be liable for any loss or damage incurred by any person as a result of delay caused that We have no control over or by any event which is out of Our reasonable control or foresight. In the case of extended delays, we will notify You of the delay and negotiate with You whether to proceed with the order or to cancel the order. If the order is cancelled under this clause, you are entitled to a full refund in the form of your original payment.

7 Receipt of Goods
(a) Subject to clause 11, You must inspect the Goods immediately upon their arrival and if the Goods are not in accordance with the specified requirements, then You must give notice to Us within 2 days of receipt of the Goods. If You fail to give such notice, the Goods must be deemed to be in all respects in accordance with the specified requirements. No claim must be recognised unless made in writing and received by Us within 2 days after receipt of the Goods by You.
8 Cancellation
Except as allowed in clause 6.2(e), if You cancel your order, unless We are in breach of Our obligations to you, We have the right to retain 20% of your original payment to cover the proportionate expenses incurred up by us arising from your cancellation.
9 Refund policy
(a) Please choose carefully. Subject to Clause 11, we do not normally give refunds if you change your mind or if You make the wrong decision.
(b) At times, We will offer a refund for change of mind provided the product/s meet Our Change of Mind Terms & Conditions. For full details on our Change of Mind Terms & Conditions click here.
(c) We do not offer change of mind refunds for items purchased using Promotions.
10 Limitation on claims
(a) We have no liability to the extent that Our performance of the Contract is prevented by force majeure. For these purposes, "force majeure" means any occurrence or omission as a direct or indirect result of which We are prevented from or delayed in performing any of Our obligations, is beyond Our reasonable control and which could not have been prevented or mitigated by reasonable diligence or precautionary measures, including forces of nature, natural disasters, acts of terrorism, riots, revolution, civil commotion, epidemic, industrial action and action or inaction by a government agency.
(b) We have no liability to the extent that a failure of the Goods is attributable to any act or omission on your part.
(c) Our liability for failure to comply with a consumer guarantee is limited to:
(i) in the case of Goods supplied by Us, the replacement of the Goods or the supply of equivalent Goods (or the payment of the cost of the replacement or supply), or the repair of the Goods (or the payment of the cost of the repair); and
(ii) in the case of services supplied by Us, the supply of the services again or the payment of the cost to the Customer of having the services supplied again.
(d) Subject to the prior, no attempt is made to exclude or limit liability arising under the Australian Consumer Law to the extent that there is a statutory restriction on such exclusion or limitation.
(e) In all other respects, Our total liability for loss or damage of every kind, whether:
(i) arising pursuant to the Terms; or
(ii) arising in any other way out of or in relation to the supply of the Goods, their sale, delivery or the way they behave, and whether in tort or Contract or in any other cause of action, is limited to an amount equivalent to the sum paid by you to Us for the Goods.
(f) Except in relation to liability for personal injury (including sickness and death), and except as otherwise stipulated in these Terms, We do not accept liability to you in respect of any indirect or special loss or damage which may be suffered or incurred by you in respect of Goods or services supplied pursuant to these Terms.
11 Warranty & Liability
(a) We accept liability for all legal guarantees and warranties expressed or implied to the transactions under the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth) (Australian Consumer Law), or any other legislation (such as the Fair Trading Acts (or equivalent legislation) in each State and Territory) the effect of which cannot be excluded.
(b) Where We are permitted by law (and subject to clause (a)):-
(i) We do not warrant or represent the suitability of the Website or a good that may be available on the Website or in our stores for any purpose; and
(ii) We will not be liable to You for indirect and consequential loss (including without limitation for loss of revenue, loss of profits, failure to realise expected profits or savings and any other commercial or economic loss of any kind) or loss or corruption of data, in contract, tort, under any statute or otherwise (including negligence) arising from or connected to the Website, Linked Sites or the Goods.
(iii) Our liability to You for loss or damage of any kind arising out of these Terms or in connection with the relationship established by it is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether Our liability is in contract, tort (including negligence), under any statute or otherwise.
(iv) Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or a refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Goods repaired or replaced if the Goods fail to be of acceptable quality and the failure does not amount to a major failure.
(v) You are also entitled to choose a refund or replacement, but only where major failures with goods have been established. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract and obtain a refund of any unused portion.
(c) Nothing in these Terms shall be read or applied so as to exclude, restrict or modify or have the effect of excluding, restricting or modifying any condition, warranty, guarantee, right or remedy implied by law (including the Australian Consumer Law) and which by law cannot be excluded, restricted or modified.
12 Your Obligations
(a) You covenant and warrant that:
(i) all information and data provided by You to us through the Website is true, accurate, complete, and up to date;
(ii) the person receiving the Goods at the delivery address is authorised by you to do so;
(iii) You have and will comply with all relevant laws relating to your use of the Website and your placement of any order to us;
(iv) if applicable, you will check the labels on the Goods before use.
(b) You must not:
(i) use the Website for any activities that breach any laws, infringe a third party's rights or are contrary to any relevant standards or codes;
(ii) use the Website in a manner or way, or post to or transmit to or via the Website any material, which interferes with other users or our other customers or defames, harasses, threatens, menaces or offends any person or which prevents any other person from using or enjoying the Website;
(iii) make fraudulent or speculative enquiries, purchases or requests through the Website;
(iv) use another person's details without their permission or impersonate another person when using the Website;
(v) use the Website other than in accordance with these Terms.
(c) You acknowledge that breaching this clause would constitute a criminal offence and, if breached, We will report any such breach to the relevant law enforcement authorities and disclose your identity to them.
(d) We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to Your use of this Website or to your downloading of any material posted on it, or on any Linked Sites.
(e) You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you. This Website must not be framed on any other site, nor may you create a link to any part of this Website other than the home page. We reserve the right to withdraw linking permission without notice.
13 Intellectual property
(a) Where applicable, the specifications and design of the Goods, software and the content on our Website(being all intellectual property, including but not limited to, copyright, design right, trademarks or other intellectual property) remain Our property. You may store, print and display the content supplied solely for your own personal use. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise.
(b) Except where expressly stated to the contrary all persons (including their names and images), third party trademarks and content, services and/or locations featured on this Website are in no way associated, linked or affiliated with the Us and You should not rely on the existence of such a connection or affiliation. Any trademarks/names featured on this Website are owned by the respective trademark owners. Where a trademark or brand name is referred to it is used solely to describe or identify the products and services and is in no way an assertion that such products or services are endorsed by or connected to Us.
14 Indemnity
You agree to indemnify, defend and hold harmless Us, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages or costs (including, but not limited to, legal fees) arising from your use of this Website or your breach of the Terms.
15 Title and risk
Title in the Goods does not pass to You until payment has been received. Risk of loss or damage to the Goods passes to You upon dispatch of the Goods regardless that they are shipped with a third party.
16 Invalidity
If any part of the Terms is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the Terms will not be affected and all other clauses remain in full force and effect. So far as possible where any clause/subclause or part of a clause/subclause can be severed to render the remaining part valid, the clause must be interpreted accordingly. Alternatively, you agree that the clause must be rectified and interpreted in such a way that closely resembles the original meaning of the clause/subclause as is permitted by law.
17 Waiver
Any waiver of any provision of the Terms will be effective only if in writing and signed by Us. Without limiting the foregoing, if You breach these conditions and We take no action, We will still be entitled to use Our rights and remedies in any other situation where you breach these conditions.
18 Entire agreement
The Terms constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and Us.
19 Governing law
These Terms are governed by the laws in force in Victoria. You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction.

21 Custom Orders & Made To Order Products
Due to the individual specifications of each Custom piece, we unfortunately do not offer cancellations, returns or exchanges for a change of mind. Should an item be deemed faulty or damaged, we will provide a replacement, exchange or refund.
22 Schots Price Match Promise
At Schots, we are committed to providing you with competitive pricing on our quality products. If you find an identical stocked item advertised for a lower price by another eligible retailer, we will match that price in accordance with these terms and conditions.
Eligibility Criteria for Price Match
To be eligible for a price match, all of the following conditions must be met:
1 Identical Item: The product must be absolutely identical in every respect, including:
- Brand, model, and specific product code/SKU.
- Colour, finish, material, and size.
- It must be from the same distributing supplier as the Schots product.
2 In-Stock and Available: The competitor's item must be:
- Available for immediate purchase at the advertised lower price.
- Available for sale directly to the general public (i.e., not a trade-only offer, member-only deal, or similar).
3 Competitor Type: The competitor must be:
- A legitimate Australian retail business with a physical store or an established Australian online store (with an ABN) that we can verify.
- Not a Schots wholesale customer.
4 Product Condition: The item must be:
- Brand new and in its original, unopened packaging.
- Not a sample, damaged item, refurbished, ex-demonstration, display model, or second-hand product.
5 Verifiable Proof: You must provide clear and verifiable proof of the advertised lower price. This can include:
- A current URL link to the specific product page on the competitor's website, showing the price and stock availability.
- A current printed catalogue or advertisement showing the price and validity period.
- Schots reserves the right to verify and validate all quoted prices and product availability directly with the competitor.
6 Total Price Consideration (Including Delivery)
- When assessing a price match request, we will also consider the total delivered price to your location. If the identical, in-stock product can be purchased and delivered to your specific location for a total price (including product cost and delivery charges) that is lower than the total price we offer, we will match that total delivered price. You must provide verifiable proof of the competitor's total delivered price.
7 Currency: All prices must be in Australian Dollars (AUD).
What We Will Match
If all eligibility criteria are met, we will match the competitor's advertised price for the identical item.
Exclusions
The Schots Price Match Promise does not apply to:
- Special finish 3rd Party items, that require special order from Schots
- Items on clearance, liquidation sales, or "run-out" stock.
- Trade pricing, commercial quantities, or wholesale pricing.
- Member-only deals, loyalty programs, or offers requiring a specific membership or discount code.
- Pricing errors by the competitor or Schots.
- Items sold through auction sites, classifieds, or third-party marketplaces (e.g., eBay, Amazon marketplace sellers).
- Prices that are a result of a bundle offer, bulk purchase discount, or "buy one get one free" type promotions.
- Retrospective price matching (i.e., we cannot price match after a purchase has been made).
How to Request a Price Match
To request a price match, please:
- Prior to Purchase: Contact our sales team 94826400 or customerservice@schots.com.au before making your purchase.
- Present the required verifiable proof as outlined in sub-section 5.
Our Discretion
Schots reserves the right to:
- Decline a price match request if, in our reasonable opinion, any of these terms and conditions are not met.
- Limit the number of identical items that can be price matched at the matched price.
- Vary or withdraw this Price Match Promise at any time without prior notice. Any price match requests submitted before such variation or withdrawal will be processed under the terms applicable at the time of the request.
Australian Consumer Law
Our Price Match Promise is offered in addition to your rights under the Australian Consumer Law (ACL). Nothing in these terms and conditions is intended to limit or exclude any of your rights under the ACL.
